These Terms and Conditions ("Terms") govern your use of the website at shapinghorizons.com (the "Site") and your participation in the SMS text-messaging program operated by Shaping Horizons, Inc. ("Shaping Horizons," "we," "our," or "us"). By accessing the Site or by receiving SMS messages from Shaping Horizons, you agree to these Terms.
Shaping Horizons, Inc. is a Florida corporation providing Applied Behavior Analysis (ABA) therapy services.

The Site is informational. We do not provide accounts, transactions, scheduling, payment processing, or clinical services through the Site. The Site's only interactive feature is a contact form, which forwards submitted messages to us so we can respond.
The content of the Site is provided for general informational purposes only and does not constitute clinical advice, diagnosis, or treatment. ABA therapy services are provided only under a separate written services agreement between the client (or the client's parent or guardian) and Shaping Horizons.
The Site's name, brand, logos, and content created by us are owned by or licensed to Shaping Horizons, Inc. and are protected by copyright and trademark laws. You may view the Site for personal, non-commercial purposes; you may not copy, redistribute, or republish Site content without our written permission. Some images, fonts, or template elements on the Site are provided by third parties (including our website-builder template) under those parties' license terms.
We operate an SMS text-messaging program for two audiences:
Caregivers and authorized contacts of clients receiving services from Shaping Horizons, for scheduling and clinical coordination.
Staff and contractors of Shaping Horizons, for work assignments and operational coordination.
By providing your mobile number to us for either purpose, you agree to the following terms:
Eligibility. Recipients must be at least 18 years of age.
Description. The program is informational and operational; it is not used for marketing or promotional messages.
Opt-in. We send SMS only to recipients who have provided their mobile number for this purpose during intake or onboarding and who have agreed to receive SMS messages.
Frequency. Frequency varies; typically between 2 and 10 messages per recipient per week.
Costs. Standard message and data rates may apply per your mobile carrier.
Help. Reply HELP to any message, or contact support@shapinghorizons.com or (954) 960-4310 for help.
Opt-out. Reply STOP to any message at any time. After we receive a STOP request, we will send one final confirmation message and will not send further messages to that number unless you re-opt-in.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. Information you provide in connection with the SMS program is handled in accordance with our Privacy Policy at shapinghorizons.com/privacy-policy.
You agree not to use the Site to:
Probe, scan, or test the security of the Site or any related infrastructure
Misrepresent your identity, impersonate any person, or submit false information through any form
Interfere with the operation of the Site or with other users' access to it
The Site may contain links to third-party websites or services, and our SMS program is operated through third-party telecommunications providers. We are not responsible for the practices, content, terms, or policies of those third parties.
To the fullest extent permitted by Florida law, the Site and the SMS program are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site or SMS program will be uninterrupted, error-free, or fully secure.
To the fullest extent permitted by Florida law, Shaping Horizons, Inc. and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or the SMS program. This limitation does not apply to liability that cannot be limited under applicable law.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from or related to these Terms, the Site, or the SMS program shall be brought exclusively in the state or federal courts located in Broward County, Florida, and the parties consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. The "Last Updated" date at the top of these Terms reflects the most recent version. Your continued use of the Site or the SMS program after a change becomes effective constitutes acceptance of the updated Terms.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shaping Horizons, Inc. with respect to the Site and the SMS program.
